ECZ must ensure presidential campaign regulations are lawful – LAZ
LUSAKA – The Law Association of Zambia (LAZ) has issued a stern reminder to the Electoral Commission of Zambia (ECZ), urging the electoral body to meticulously ensure that all regulations pertaining to presidential campaigns are strictly in accordance with the country's existing legal statutes. This call comes amidst heightened political activity and the perennial need for transparent and equitable electoral processes in Zambia. LAZ, a pivotal voice in upholding the rule of law and good governance in Zambia, emphasised that any regulatory framework developed by the ECZ must not only facilitate orderly campaigns but also scrupulously respect fundamental rights such as freedom of assembly, expression, and political participation. The association's concern reportedly stems from the potential for regulations to inadvertently or deliberately stifle legitimate political discourse or create an uneven playing field for candidates vying for the nation's highest office. Historically, campaign regulations have often been a point of contention, with opposition parties frequently alleging that rules are crafted or enforced in a manner that disadvantages them. Ensuring the legality of campaign regulations is paramount for the credibility of Zambia's democratic institutions. Unlawful or overly restrictive rules can lead to legal challenges, erode public trust in the electoral process, and potentially spark civil unrest. LAZ's intervention serves as a proactive measure, aiming to pre-empt such issues by advocating for a framework that is both robust and constitutionally sound. This includes scrutinising aspects such as campaign financing, use of public media, public gathering permits, and the conduct of political rallies, all of which must align with the Republican Constitution and other relevant electoral laws. The ECZ, as the independent body mandated to manage and supervise elections, bears the heavy responsibility of interpreting and implementing electoral laws fairly. LAZ's
